Summary Judgment in Professional Negligence Case Unanimously Affirmed

Recently the Mississippi Court of Appeals unanimously affirmed a summary judgment dismissing a claim of professional negligence against an attorney.  In Grandquist v. Robertson, the Plaintiff and a property owner agreed to a sale of a parcel in George County.  The property owner's attorney prepared a warranty deed transferring the parcel to the Plaintiff.  However, upon conclusion of the transaction, the property owner failed to cancel the deed of trust against the parcel.  Eventually the holder of the deed of trust foreclosed upon the parcel, divesting the Plaintiff of the property.  The Court held no negligence occurred on the part of the attorney-defendant since his professional duties were limited to the preparation of a warranty deed; not an investigation of the title to the parcel or whether any liens against it existed.

The defendant/attorney was represented on appeal by Jessica Dupont and James Heidelberg.
