Jury Verdict in Business Dispute

A Jackson County jury unanimously found for firm clients, defending against a claim for unpaid crane rental and attorney fees totalling almost $200,000.  Industrial & Crane Services, Inc. and its sole shareholder were sued for lost rent during the time a crane rented by ICS was being repaired after an accident.  Repairs to the damaged crane had been previously paid by ICS's insurer.  However, the crane owner sought payment for lost rent for the 13 months in which it took to repair the crane.  ICS successfully defended the case by showing the plaintiff's rental contract did not provide for lost rent in cases of damage, and was otherwise ambiguous.  ICS also showed the Plaintiff suffered no actual damages in lost rent, since it could not show any job, bid or other work lost due to a lack of available, similar cranes.
