An Indiana hospital and physician have been dismissed from breach of contract/defamation action due to a lack of personal jurisdiction. The plaintiff sued firm clients, Parkview Hospital, Inc. and Dr. Greg Johnson, for tortious interference with contract, defamation and other causes of action after a Mississippi hospital backed out of a contract, allegedly in part due to comments and information supplied by the non-resident defendants. In a written opinion granting a motion to dismiss, the US District Court for the Southern District of Mississippi held the Plaintiff failed to show the requisite minimum contacts existed between the Indiana defendants and Mississippi in order exercise personal jurisdiction.
