The Mississippi Court of Appeals affirmed a decision in favor of Beau Rivage Resorts, Inc. in a workers compensation complaint. The
claimant-employee alleged she injured her shoulder at work and could not return
to gainful employment. Beau Rivage demonstrated at trial that the employee's shoulder complaints were the same before and after her workplace accident, and any additional injuries resulting from her accident were merely temporary. The Mississippi Worker's
Compensation Commission agreed with the employer finding that the
employee-claimant was only entitled to temporary benefits as her injury was a
temporary aggravation of a pre-existing condition. Dissatisfied with the
decision, the employee appealed the Commission's decision. The Court of Appeals affirmed the decision denying the employee any additional benefits for her on-the-job injury beyond
what was been paid for her temporary injuries.
